Congratulations You Just Married your Foreign Fiance by Art Saborio
Wow you got married last week So how was it finally having your foreign fiance arrive in the USA I bet it was a great feeling to finally be together in the same country together. I know those long trips back forth were hard for the both of you. Now you get to see each other everyday even wake up to each other. How great that must feel.
Being married is such a great thing but I think you forgot something. Being married does not mean your spouse can stay in the USA. The K1 Visa is still hanging around it needs to be taken care of as quickly as possible. From what I know you only have a short amount of time before that K1 Visa expires. You must be wondering how you can get this done correctly do it in the amount of time allowed.
In the old days just being married was enough to warrant a change in status but times have changed. We are both come form same era when getting something done was much easier. Now you have to deal with Homeland Security USCIS god knows how many other agencies just to remained married in the USA. But all this is necessary to remove the conditional visa change your spouse over to a Permanent US Immigrant Resident Status.
I know you really have no idea how to go about doing the change of status. Let me tell you that K1 Visa we worked on together last year is less complicated than the adjustment of status. There are more forms to submit more supporting documentation that needs to go with those forms. I know it sounds hard but there is no way around it. The best thing to do is let me be your guide. I can get you around the harder parts of the process.
Now I don't want to scare you but the adjustment of status process has a higher percentage of denials than the K1 Visa Process. Remember that the K1 Visa Process had a forty percent denial rate. So you can imagine what that can mean for you your spouse.
Why such a high percentage of denials for the change of status Well the first reason is people tend to not take this as serious as the K1 Visa. They think they are married don't have to prove anything to the USCIS. Well I can tell you that is best way to get your adjustment denied. The second reason is not knowing what to do submitting the wrong information. Most people will not bring the right information to the interview or fail to submit the required information to the USCIS.
What happens if you get denied. If you are denied you have two options available to you. & these options are not in your control. The first is coming back for a second interview. You must be invited back you cannot make your own appointment. The second way is reapplying again.
Now it costly to apply the first time. The fee is over a thousand dollars. So imagine if you had to reapply. The cost can get up there. If you are lucky enough to be called back for a second interview then you get a second chance to prove your marriage life together. Usually at the second interview a couple will get an approval.
I hear you are concerned about deportation Don't quote me on this but it really takes multiple denials for anything bad to really happen. Since you your wife have not gone through the first interview I don't want you stressing over this. For one you have me on your side to guide you through all this secondly I know a few tips tricks to give you the edge on a positive outcome. But if you really want to know what would happen with multiple denials I will tell you. You will need to find yourself a very very good attorney. One that knows Senators. It will be through the good graces of a senator to make all your troubles go away.
Now sit back relax while I talk a little about the process. The form that everyone needs to subm it the I 485. It is the one that rules all other forms supporting documentation. Submit this packet correctly you get a nice little acceptance letter form USCIS. Submit the application wrong you are in for a world of trouble. With the nice little acceptance letter comes the fingerprinting then the interview.
Good luck with the process if you need any help you know where to find me. I can lead you down the right path if you get lost along the way. Take care again congratulations on your happy day.
